Kaisa Bespoke Training Terms & Conditions

1. Introduction

  • What these terms cover.  These are the terms and conditions of personal training and fitness classes and they apply and are part of any Registration Form that you complete and the contract between you and Kaisa Bespoke Training.

  • Why you should read them.  Please read these terms carefully before you register.  These terms tell you who I am, how I will provide the classes and services to you, how you and I may change or end the Training contract, what to do if there is a problem and other important information.  If you think that there is a mistake in these terms please contact me to discuss.

 

2. Information about Kaisa Bespoke Training

  • Who am I.  Kaisa Bespoke Training.  My studio is located at 15 Chantry Rise, Olney, Buckinghamshire, MK46 5FE.

  • How to contact me.  You can contact me by email hello@kaisabespoketraining.com or alternatively you can write to me at the above address.

  • How I may contact you.  If I have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your registration form

​3. Some definitions

To make it easier to understand these Terms we use the following definitions: 

  • “we/us/our/I” means Kaisa Bespoke Training 

  • “you/your” means an individual who applies to become one of my clients and also that person once accepted as a client.  

  • “these Terms” means these terms and conditions of clients of Kaisa Bespoke Training 

  • “Registration Form” means the form that you complete when you apply to become one of my clients.  

  • “client” means a client of Kaisa Bespoke Training whose application for Personal training has been accepted on completion of a Registration Form and all associated form and questionnaires.

  • “Studio” means my fitness studio located at 15 Chantry Rise, Olney, MK46 5FE.  

  • “Class” means any individual or group class or session at any location also classes online.  

  • “Website” means My website at www.kaisabespoketraining.com 

  • “Writing” includes emails.  When I use the words “writing” or “written” in these Terms, this includes emails

4. Client Application

  • You may apply to become a Client by completing a Registration Form and associated forms and questionnaires and agreeing to these Terms. 

  • Acceptance of a person as a client is at my absolute discretion and you will only become a client if and when I accept your application and you have paid the relevant costs.

  • The details that you provide in the Registration Form must be complete and correct and that you agree to these Terms.

 

5. Payment terms

  • No client can join any class or session without first paying for the relevant Class.

  • Details of prices on the Website and shall be such prices as I determine from time to time. 

  • Payment for individual Classes and Personal training can be made online, cash or cheque.

  • Subject to any statutory rights of cancellation, payments for Classes, Personal training , gift certificates are non-refundable and non-transferable unless otherwise stated in these Terms and Conditions. Refunds, if any, shall be made entirely at my discretion. 

6. Your right to cancel

  • For most goods and services bought online you have a legal right to change your mind within 14 days and receive a refund.  These rights, under the Consumer Contracts Regulations 2013, are explained in more detail below.

  • You do not have a right to change your mind in respect of Classes, once these have been completed.

  • For details on how to cancel Class bookings please see clause 9 below

  • To cancel, please let us know by doing one of the following:

    • Email me at Hello@kaisabespoketraining.com . Please provide your name, home address, and your phone number and email address.

 

8. Limitations of liability 

  • I am responsible to you for foreseeable loss and damage caused by me.  If we fail to comply with these Terms, I am responsible for loss or damage you suffer that is a foreseeable result of me breaking this contract or my failing to use reasonable care and skill, but I am responsible for any loss or damage that is not foreseeable.  Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both myself and you knew it might happen, for example, if you discussed it with me during the sales process.

  • I do not exclude or limit in any way my  liability to you where it would be unlawful to do so.  This includes liability for death or personal injury caused by my negligence for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to my supply of services with reasonable skill and care.

  • I am not liable for business losses.  I only supply my  Classes and facilities for private use.  I will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

  • Availability. I cannot be held responsible for any particular Class and/or item of equipment not being available for any reason. 

 

9. Booking 

  • Classes can be booked by phone or email.

  • Class sizes can be limited and so all bookings are based on first come first serve basis so please make sure you book in advance to avoid disappointment. 

  • I may cancel a Class booked by you at any time before the time and date of that Class in the following circumstances:

    • The required instructor and/or equipment is not available; or

    • An event described in clause 13 below occurs and continues for more than 14 days.

 If I cancel a Class in such circumstances I will refund to you the fee you have paid for that Class or provide a credit for an alternative class. 

    • Children under the age of 16 may only use the studio and attend Classes if parent or guardian has agreed.

 

11. Fitness and Health

  • You will be asked to fill out a questionnaire as part of your Membership application in which you must state clearly any health issues/conditions and provide a release form from your medical adviser if these issues/conditions prevent you from doing any form of exercise/Classes.

  • It is a clients responsibility to ensure that their physical condition is appropriate for participating in Classes and training and to ensure that they correctly operate or use any facilities and/or equipment provided by myself including the adjustment of levels or settings on any equipment. 

  • Some classes involve intensive exercise. You must familiarise yourself with what each Class involves before assessing whether you are fit to participate in a Class. You should refer to the website or speak to myself for further information.

  • I am not medically trained and are therefore not qualified to assess whether you or any guest is in good physical condition and/or that you can engage in any exercise without detriment to your health, safety, comfort or physical condition.

  • You are advised not to undertake any physical activities without first seeking medical advice if you have concerns over your physical condition. I reserve the right to refuse access to any client if, in my absolute discretion, I consider that your health may be endangered by the use of my facilities.

  • If you suffer from low/high blood pressure and/or cardiac irregularities you should not attend any Class unless you have written permission from your doctor or do so at your own disgression.

  • You should not use the facilities if you have any infectious or contagious illness, disease or other ailment or are suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the health, safety, comfort or physical condition of the other clients and myself. If there is any doubt, you should consult your doctor and must notify me of any circumstances affecting your health which may be exacerbated through continued use of a studio.

  • You are required to follow the instructions of myself at all times.

  • You must inform me if you suffer any injuries or conditions which may affect your ability to participate in the Classes.

  • I reserve the right to exclude you from a Class if it becomes apparent during that Class that you are suffering from any kind of health or physical issue that may present a danger to yourself or to others.

  • You must not attend any Class when under the influence of alcohol or illegal drugs or immediately after a heavy meal. 

12. Personal Belongings, Dress and Safety

  • Clients are requested to wear a form of clothing appropriate to the Classes they attend. Suitable footwear must be worn for classes and personal training sessions, clients should not walk around at the studio barefoot to avoid passing on any verruca or similar foot complaints.

  • Clients must use the side gate entrance the studio when entering or leaving. 

  • In the event of a fire, clients are asked to make their way to the nearest available exit and assemble at a safe distance.

  • All equipment is cleaned after each use in the studio.

 

 

14. General

  • clients must:

    • at all times observe the guidelines which I may notify to you from time to time; 

    • not smoke in any areas of the studio

    • not bring any animals into the studio (with the exception of registered medical assistance dogs).

  • You will be asked for consent to having your photograph taken by me whilst using the facilities for press, personal training and promotional purposes. If you specifically do not want your photograph used for such purposes then you must notify me.

  • I may communicate with you by email. By providing an email address to me, you consent to receiving email communications from myslef including notices pursuant to these Terms. 

  • You also accept the risk that email may not be a secure and confidential means of communication. I will not be liable for any loss or damage suffered as a result of communicating with a Client by email.

  • You agree not to engage in negative comments, libel or slander regarding the Centre including, but not limited to, publishing, or causing to be published, complaints or derogatory comments about myself in any format including, but not limited to, print, newspaper, television, radio, social media or on internet complaint sites, blogs or other public internet forums.
